1. At the outset, learned counsel for the petitioner as well as learned counsel for the State jointly draws attention of this Court to the pleadings of the return in which it has been stated that petitioner's claim of 'out of turn promotion' is under active consideration of the Department.

2. It appears that presently, the petitioner's claim is under consideration and has
