Order passed on 10/01/2017 By this review petition, the petitioner seeks review of order dated 24/11/2016 by raising ground that the respondents would take advantage of the order passed by this Court and the petitioner would not get relief of being posted at Durg till completion of normal tenure of three years. This Court, after taking into consideration the entire circumstances of the case, particularly taking into consideration the fact of petitioner's posting at various places observed that as the husband of the petitioner is posted at Bhilai Steel Plant, the petitioner is always insisting to be posted nearby Bhilai. In this background, the order has been passed by this Court.
This Court, for that reason only, observed that it is not inclined to direct the respondents to consider petitioner's representation in the present season and granted liberty to the State to consider change of posting only upon completion of normal tenure of posting. This Court has already clarified that this would be a matter to be considered by the State, subject to administrative exigency. Meaning thereby that after completion of normal tenure of posting, if the exigency permits, the petitioner may be transferred to any other place. Therefore, the order passed by this Court does not require any modification. Review petition is accordingly dismissed. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
