1. This is an application filed under section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant in connection with Crime No. 182/2015 registered at Police station City Kotwali, Dhamtari, District Dhamtari (C.G) for the offence punishable under section 20-B of the Narcotics Drugs and Psychotropic substances Act.
2. As per the prosecution case, on 29.06.2015, on secret information being received about the illegal possession of contraband ganja, the place was raided by the Police where 08. Kgs., of ganja was recovered from the applicant.
3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and the recovery of possession was not from the possession of the applicant, therefore, the seizure was doubtful. He further submits that the applicant being lady and looking to the period of her detention, she may be enlarged on bail.
4. Per contra, learned State Counsel opposes the prayer for grant of bail.
5. Considering the evidence and documents filed alongwith the charge sheet, it is not a case to hold that the seizure is doubtful and no offence is committed by the applicant. Therefore, I am not inclined to allow this bail application. Accordingly, it is dismissed.
