Hon'ble Shri Justice P. Sam Koshy Order on Board 10.06.2021
1. Aggrieved by the orders dated 27.03.2021 and 03.04.2021 transferring the petitioners from Forest Range Office, Sukma to Jagdalpur and Forest
-2Range Office Kondagaon to Flying Squad in South Kondagaon Forest Division, the present writ petitions have been filed.
2. On a query to the counsel for the petitioners, he fairly concedes that the petitioners have put in more than 4 and 3 years of service at the present place of posting.
3. This court is not inclined to entertain the writ petitions only on the ground that the petitioners have completed their normal tenure of service of three years at the present place and that they have been shifted only after four and three years respectively. The ground that the persons who are replacing the petitioners are persons who are juniors to the petitioners cannot be a ground for assailing the order of transfer of the petitioners which otherwise is in accordance with rules governing the field, inasmuch as, the petitioner's service conditions have not been infringed nor is the service conditions of the petitioners being adversely affected in any manner.
4. Thus, no strong case for entertaining the writ petitions are made out by the petitioners. Therefore both the petitions deserve to be and are dismissed. Sd/- (P. Sam Koshy) Judge inder
