This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.258/2015, registered at Police Station - Bemetara, District - Bemetara (C.G.) for the offence punishable under Section 20 (B) of N.D.P.S. Act. 2.

Case of the prosecution, in brief, is that on 08.05.2015 from the possession of the applicant, 3 kg of cannabis were recovered, thereafter, after formality, the case was registered and after investigation, the charge sheet has been filed. 3.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He would further submit that three witnesses are examined and other witnesses are still to be examined. He would further submit that no seizure has been made from the present applicant and the applicant is in jail since 08.05.2015, therefore, he prays that the applicant may be released on bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties and perused the case diary.

Considering the documents available on record, without any observation on merits, I am not inclined to allow this application. However, the Trial Court is requested to expedite the trial. 7.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
