22.02.2021 Heard on the application for grant of leave to appeal.

Though learned State counsel would submit that the prosecutrix in her 164 CrPC statement has clearly stated regarding commission of rape after abduction, we find that in the Court the prosecutrix has not supported the case of the prosecution, turned completely hostile, and even refused to identify the accused.

Face this such an evidence, the trial Court had no option but to acquit the accused. Application is misconceived and therefore, dismissed.
