1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.749/2020 registered at Police Station City Kotwali, District Raigarh (CG) for the offence punishable under Section 406 of the IPC.

3. The applicant was working as the Collection Agent in Jana Small Bank Finance Limited, Dhimrapur, Raigarh.

4. It is alleged that during the period from 2016-2019, the applicant collected total amount of Rs.48,840/- from 20 depositors but did not deposit the amount with the Company till date. The FIR has been lodged by the Branch Manager of Jana Small Bank Finance Limited on 10.10.2020.

5. Considering that the applicant is in jail since 26.3.2021 i.e. for about 4 1⁄2 months and the offence is triable by the Judicial Magistrate First Class, I am inclined to release the applicant on regular bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
