The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 120/2015 registered in Police Station Premnagar, District-Surajpur, (C.G.) for offence punishable under section 420/34 of IPC.

As per the prosecution case applicant along with co-accused have taken Rs.12/- each from 100 villagers for verification of the ration card and thereafter placed seal over such ration card, thereby cheated villagers and obtained Rs.1200/-.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and considering the nature of the offence it demolishes case of the applicant as the applicant could not have indulged in cheating for the small amount. He submits that applicant has already been arrested and the documents have been seized. He therefore submits that applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Having regard to the nature of the offence and the allegation made against this applicant, way the offence is committed, taking into fact that applicant is in jail since 11/10/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
