The present MCC has been filed by Applicant seeking for restoration of WPS No.574/2021 which got dismissed by a peremptory Order passed by this Court on 12.2.2021.

Subsequently, an MCC was filed i.e. MCC No.176/2021 for restoration of WPS No.574/2021, which was allowed by this Court vide Order dated 23.3.2021 subject to the Applicant depositing of an amount of Rs.1000/- to the Chhattisgarh High Court Bar Association Library Fund within a period of one week. 3.

Learned Counsel for Applicant submits that on account of Holi holidays and because of the annual closure of the accounts of the Banks, the said amount could not be deposited within seven days as directed by this Court, however, the same has subsequently been deposited on 6.4.2021 and, thus, the delay in depositing the cost may be condoned and WPS No.574/2021 may be restored to its original number.

On due consideration of the facts and circumstances of the case, the MCC is allowed. Accordingly, WPS No.574/2021 is restored to its original number with a rider that the Applicant/Petitioner shall remove the defaults pointed out by the Registry at the first instance in the original Writ Petition within a further period of seven days starting from today and thereafter the matter may be listed for admission on 18.8.2021.
