Agrawal Order On Board By 05/11/2015 (1) According to learned counsel appearing for the State, impugned order passed by the Zila Panchayat placing the petitioner under suspension under Chhattisgarh Panchayat Sewa (Acharan) Niyam, 1988 is appealable before the General Administration Committee of the concerned Zila Panchayat by virtue of provisions contained in Rule 15 of the Chhattisgarh Panchayat Service (Discipline and Appeal) Rules, 1999 and, therefore, he may be permitted to withdraw this petition with liberty to file appeal before the competent appellate authority.
(2) Liberty is granted, as prayed for.
(3) Accordingly, the writ petition is dismissed as withdrawn. In the eventuality of filing any appeal before the competent appellate authority within 30 day from today, the concerned appellate authority shall consider and decide the appeal in accordance with law as early as possible preferably within a period of 45 days from the receipt thereof along with the copy of this order.
