Learned counsel for the parties submit that a compromise outside the Court was effected between the parties, whereby the respondents agreed to pay a sum of Rs.1,70,000/- (Rupees One Lakh Seventy Thousand only) to the appellant. Therefore, the appellant may be permitted to withdraw this appeal. 2.

Learned counsel forthe appellant also prays for refund of the court fee. 3.

The respondents shall deposit the amount of compensation within a period of two months from today, failing which this amount will carry interest @ 7.5% per annum from the date of filing of the application till actual realization. 4.

In view of compromise arrived at between the parties, the appellant is permitted to withdraw this appeal. Since the dispute is settled between the parties outside the Court, the appellant is entitled for refund of court fee. 5.

Accordingly, the appeal is dismissed as withdrawn. The appellant will be entitled for refund of the court fee as per law.
