Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/04/2017 Heard.
1. The petitioner has challenged the notice dated 30.3.2017 issued by the Chief Executive Officer, Janpad Panchayat, Charama, by which the notice of holding 'no confidence motion' proceedings was scheduled to be held on 7.4.2017.
2. Learned counsel for the petitioner clearly submits that after filing of the petition, the 'no confidence motion' proceedings were already held in the convened meeting and motion has been passed.
3. In view of the above, I am not inclined to examine the matter because the petitioner has a remedy of filing dispute under Section 21 (4) of the Panchayat
-2Raj Adhiniyam, 1993.
4. Considering that this petition was filed by the petitioner on 10th April, 2017, if the petitioner approaches the competent authority within a period of 10 days, the dispute shall be treated to be within limitation and decided on merits.
