The present is an application filed under Section 439 of CrPC seeking for grant of bail to the Applicant who is in jail since 25.4.2017 in connection with Crime No. 87/2017 registered at Police Station- Rajim, District- Gariyaband, for the offence punishable under Sections 419, 420, 467, 468 & 471 read with Section 34 of IPC.

This is a repeat bail application. The earlier one stood rejected vide order dated 27.11.2017 on merits.

Learned Counsel for the Applicant tries to harp on the fact that the dispute is of civil in nature and the fact that since the Applicant he is in jail since 25.4.2017, considering the period of custody undergone he may be released on bail.

However, perusal of record would show that the nature of allegation against the Applicant is that of selling the properties belonging to his father by impersonation, inasmuch as he had presented some other person as his father and got the property sold.

Given the facts and circumstances of the case, reserving the right of the Applicant to revive the bail application after the material witnesses more particularly the father of the Applicant are examined before the Court below, the present application for grant of bail stands rejected. 6.
