Mr. Anupam Dubey, Dy. Govt. Advocate for the State. Heard Learned counsel for the appellant submits that the appellant was in jail since 18.05.2007 and after conviction, the application for suspension of sentence and grant of bail was dismissed on 11.10.2008 and thereby he has completed the entire jail sentence. He further submits that the fine amount was already paid. Perused the judgment of the Court below. It appears that the appellant was convicted on 15.09.2008 and he was in custody since 18.05.2007.
Considering the fact that the counsel for the appellant do not want to press this appeal on merit on the ground that the appellant has already undergone the sentence, the appeal is dismissed as having become infructuous.
