1. At the outset, learned counsel for the applicant in MCRC No.3343 of 2021 prays for some time to file certain documents.

2. As prayed, list MCRC No.3343 of 2021 after four weeks.

3. Both the aforesaid bail applications i.e. MCRC No.2834 of 2021 & MCRC No.2878 of 2021 filed under Section 439 of Cr.P.C. are being disposed of by this common order.

2. Allegation against the present applicant is that he committed theft of Scorpio Vehicles bearing registration Nos. JH03-AS-6795 & JH03-AN9775 from the house of complainants namely Anjum Ansari & Panjak Jumar Kashyap on 29.11.2020.

3. Learned counsel for the applicant submits that applicant is an innocent person and has been falsely implicated in this case. He submits that

applicant has not played any role in alleged offence. Applicant is in jail since 11.12.2020, charge sheet has already been filed and due to COVID 19-pandemic conclusion of trial is likely to take some time. Therefore, the applicant be released on bail.

4. On the other hand, learned counsel for the State opposes the bail applications.

5. Heard learned counsel for the parties.

6. Considering the facts and circumstances of the case, the number of criminal antecedents against the applicant of similar nature, the allegation against the applicant in this case is that he committed theft of two Scorpio vehicles and sold the same thereafter, the material so far collected against the applicant, without commenting anything on merits of the case, I am not inclined to release the applicant on bail.

7. Accordingly, both the bail applications are rejected. However, bail application MCRC No.3343 of 2021 is directed to be listed after four weeks.
