Judgment on Board Per Navin Sinha, Chief Justice 18/01/2016 1.

The present appeal arises from order dated 17.12.2014 disposing Writ Petition (S) No. 4905 of 2015 withdrawn for preferring a statutory appeal against the order of suspension under the Chhattisgarh Civil Services (Classification Control & Appeal) Rules, 1966.

Learned Counsel for the Appellant sought to persuade us that the Sub Divisional Officer was not authorized to pass the order of suspension.

In view of the writ petition having been withdrawn as noticed in paragraph 3 of the order to prefer a statutory appeal, we are not inclined to entertain this appeal. The grounds sought to be urged can very well be raised before the appellate authority also.

At this stage, Learned Counsel for the Appellant prays for leave to withdraw the appeal for pursuing the appellate remedies. 5.
