The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.42/2020, registered at Police Station Kurud (Out Post Birejhar) District Durg (CG), for the offence under Section 397, 34 of the Indian Penal Code.

Applicant assaulted the victim Jawahar Patel by knife and looted mobile valued at Rs.2,000/- and similarly looted cash of Rs.800/- from Deenu Patel in the incident which took place at 7.00 pm on 26-1-2020.

The first bail application was dismissed as withdrawn with liberty to revive the prayer after examination of the victim Jawahar Patel.

Considering the deposition of Jawahar Patel where he has not identified the applicant and for the fact that the applicant is in jail since 27-1-2020 i.e. for about one year seven months, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
