1. Challenge in this appeal is to the judgment of conviction and order of sentence dated 14.7.2015 passed by the Special Judge (NDPS, Act), Durg in NDPS Case No.01/2015 thereby convicting the appellant under Section 20 (B) (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and sentencing him to undergo RI for 5 years & fine of Rs.25,000/-, in default to undergo additional RI for 01 year.
2. At the outset, Shri Singh submits that prior to filing of this appeal, the appellant had already made a request to the High Court Legal Services Authority, Bilaspur through the jail authority for providing him legal aid and accordingly Criminal Appeal No.1389/2015 has been filed on behalf of the appellant by Shri K.K. Dewangan, Advocate. Therefore, he may be permitted to withdraw this appeal, however, he prays for liberty to file suitable application in Cr. A. No.1389/2015 for appearing on behalf of the appellant along with Shri K.K. Dewangan, Advocate.
3. In view of above, this appeal is dismissed as withdrawn with the liberty aforesaid.
