1. This is an application filed under section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant in connection with Crime No. 335 of 2015 registered at Police station Khairagarh, Distt. Rajnandgaon (C.G) for the offences punishable under section 354, 506 of IPC and Section 8 of Protection of Children from Sexual Offences Act, 2012.

2. As per the prosecution case, the victim was student of Class XI and on 03.10.2015 while she was coming back to her house from school, the applicant met her and caught hold her hand and dragged her on the ground that she does not talk to him. She was also further threatened.

3. Learned counsel for the applicants submits that the charge sheet in this case has been filed and the applicant is in jail since 04.10.2015 and considering the degree of offence he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of bail.

5. After going through the statement of victim wherein the allegation of

pulling her hand is made against the applicant and considering the degree of allegations as also the fact that the charge sheet has already been filed and the applicant is in jail since 04.10.2015, I am inclined to allow this bail application.

6. Accordingly the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He shall appear before the said Court on each and every date to be give by the said Court.
