(2) Learned counsel appearing for the State/respondent submits that the impugned order dated 19.01.2016 (Annexure P-1) passed by the State Government/respondent is appealable before the appellate authority under Rule 23 of the Chhattisgarh Civil Services (Classification, Control & Appeal) Rules, 1966 (in short "the Rules, 1966").

(3) At this stage, learned counsel appearing for the petitioner submits that the petitioner may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the appellate authority within a period of 15 days from today.

(4) The prayer appears to be fair and reasonable. (5) The writ petition is accordingly disposed of with a direction to the petitioner to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of 15 days from today and, in turn, the appellate authority shall consider and decide the same in accordance with law, after affording proper opportunity of hearing to the parties, expeditiously.
