Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 27-03-2021 in connection with Crime No.174/2021 registered at Police Station - City Kotwali, Mungeli, Chhattisgarh for the offence under Section 20(A) of the N.D.P.S. Act. 2.

It is submitted by learned counsel for the applicant, that the applicant has been falsely implicated. He is in jail since 27-03-2021. The charge sheet has been filed and the trial is not making any progress. Therefore, it is prayed that this application may be allowed.

Heard learned counsel for the parties and perused the case diary. 5.

51 plants of cannabis were found growing in the premises of this applicant which have been seized. The total weight of the plants seized is 940 grams.

Considered on the submissions. As the charge sheet has been filed, the applicant is local resident of District Mungeli and the trial is also pending against him so far, therefore, I feel inclined to allow this application.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 8.
