This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants who have been arrested in connection with Crime No.84/2015 registered at Police Station- Narayanpur, District Narayanpur (C.G.) for the offence punishable under Section 363, 370 and 34 of Indian Penal Code.

As per the prosecution case, in brief, the applicants who are the Managers of the Boring Company contacted one Shankar Salam and thereafter ten persons were being taken to work at Company and the remuneration was fixed at Rs.7000/- per month. Out of ten, two workers were minor and while they were taken away they were intercepted and the offence was registered. 3.

Learned counsel for the applicants submits that the applicants have engaged the services and it is not a case of human

trafficking rather they were provided employment at the behest of Shankar Salam who had also gone with the applicants for employment. He further submits that the applicants are in jail since 09.08.2015, therefore, they may be enlarged on bail. 4.

Per contra, learned State counsel opposes the prayer for grant of bail.

I have heard learned counsel appearing for the parties, perused the case diary.

Having regard to the statement that the applicants have engaged the services to work in the Boring Company and further taking into fact that the charge sheet has been filed and considering the evidence available against this applicants, I am inclined to release the applicants on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicants shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court, for their appearance as and when directed. 9.
