Hon'ble Vacation Judge Order on Board 23/05/2018 Heard.

1. The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.224/2017, registered at Police Station Dongargaon, Distt. Rajnandgaon (CG) for the offence punishable under Sections 365, 366 and 376/34 of the IPC.

2. Although there is allegation that the applicant and co-accused Dwarka Ratre abducted the prosecutrix by making her unconscious, but material available in the case diary would reveal that she stayed with the applicant for about three months and during this period she never resisted the relationship and she never revealed about the applicant's sexual adventure to anybody while she was staying at Chikhli,

Rajnandgaon. The prosecutrix is 21 years of age.

3. Considering the delay in lodging the F.IR., the present is considered to be a fit case for release of the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
