1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 112/2015 registered at P.S. Darima, Distt. Surguja (C.G) for the offence punishable under Sections 420, 467, 468, 471 of IPC.
2. Prosecution case, in brief, is that on 27.08.2015 a complaint was made by Videsh Kumar and others that the applicant has received the amount of Rs.2,95,000/- for providing the job on the post of supervisor in rural health department and thereafter issued the appointment letter and paid salary for one month. Subsequently, it was found that the appointments are fake, therefore, the crime was committed and the case was registered.
3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and he is in jail since 28.8.2015. He further submits that the charge sheet has already been filed and prays for releasing the applicant on
bail.
4. Per contra, learned State Counsel opposes the bail application.
5. Taking into the gravity and degree of offence committed and further taking into the fact that the offences are triable by the JMFC and the detention period of the applicant as he is in jail since 28.8.2015, I am inclined to release him on bail. Accordingly, this application is allowed.
6. The applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court . He is directed to appear before the trial Court as and when directed by the said Court.
