1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 193/2015, registered at Police Station- Sakti (C.G.) for the offence punishable under Sections 419,420,34 of IPC.
2. As per the prosecution case, in brief, is that the applicant had shown himself as the RBI Officer and took account number, ATM number and Password of the complainant and withdrawn an amount of Rs. 3,40,240/- online. Subsequently, a report was made against this applicant and on the basis of the above report, the offence punishable under sections 419,420,34 of IPC.
3. Counsel for the applicant submits that the applicant has been falsely implicated in this case and the allegation made against the applicant only on the basis of suspicion he has been inculpated in the aforesaid crime and the case is being investigation and the
evidence still have been collected and therefore, he may be enlarged on bail.

Considering the case diary and the nature of allegation leveled against the applicant and considering the fact that after obtaining ATM number and Password an amount of Rs. 3,40,240/- was withdrawn by the applicant, I am not inclined to release the applicant on bail at this stage.
