This application under Section 438 of the Code of Criminal Procedure has been filed by the applicant who is apprehending his arrest in connection with Crime No.210/2021 (wrongly mentioned as 210/20 on 2nd page of lower court order) registered at Police Station - City Kotwali, Balodabazar, District Balodabazar, Bhatapara (C.G.) for commission of the offence punishable under Sections 34 (2) and 36 of Excise Act.

Learned counsel for the applicant submits that the applicant has been arrested and, as such, the instant MCRC(A) has become infructuous.

Accordingly, the MCRC(A) No.560/2021 is dismissed as having become infructuous.
