SB: Hon'ble Shri Justice P. Sam Koshy Order On Board 17/08/2017

1. Alleging non compliance of court's order dated 05.01.2017 passed by this court in Writ Petition (S) No.6433 of 2016, the instant contempt petition has been preferred by the petitioner.

2. Learned counsel for the respondent has filed its return today along with copy of order dated 24.07.2017 (Annexure R/1) whereby it is reflected that the case of the petitioner has been considered by the State authorities and have granted the relief which he was seeking of grant of Kramonnati/Time Scale.

3. In view of the fact that the respondent-State has already issued an order in favour of the petitioner and which is likely to be acted upon at the earliest as specific direction have been issued to the local body, this court is of the opinion that the order dated 05.01.2017 passed by this court in Writ Petition (S) No.6433 of 2016 stands acted upon in its letter and spirit and as such nothing further remains to be adjudicated upon in this contempt petition.

4. Accordingly, the contempt petition is disposed of. Needless to mention that in the event the grievance of the petitioner still survives, he would be at liberty to challenge the same afresh.
