The present MCC has been filed seeking restoration of WP(C) No. 851 of 2020 which was got dismissed by a peremptory order dated on 05.03.2020.

The contention of the petitioner was that the order for issuance of notice by this Court was both modes, however, inadvertently, the petitioner has paid not P.F. by ordinary mode, the P.F. by registered mode was submitted within the time specified. Subsequently, he has submitted the P.F. by both modes.

Considering the submission made by the Counsel for the petitioner, this Court is of the opinion that a strong case for allowing the MCC is made out. Accordingly, the MCC stands allowed and the writ petition i.e. WP(C) No. 851 of 2020 stands restored to its original number.

No order as to cost.

The present MCC accordingly stands allowed and disposed off. Let a copy of the order passed in the present MCC be made part of the record of the WPC No. 851/2020 decided on 05/03/2020. Sd/- (P. Sam Koshy) JUDGE
