This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 365/2015 registered at Police Station - Kurud, District -Dhamtari (C.G.) for the offence punishable under Sections 295 of IPC. 2.

As per the prosecution case, in brief, is that on 30.09.2015 the applicant damaged to the deity which was kept near the Shitla Temple under the Neem Tree and therefore, also cause damaged to the statue of Bajrangbali and thereafter the case was registered against the applicant.

Counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case and he is in jail since 30.09.2015 and therefore, he prays that the applicant may be released on bail.

On the other hand, learned counsel for the State opposes the bail application.

Having regard to the fact that the charge sheet in this case has been filed and the applicant is in jail since 30.09.2015 and the offence was trible by JMFC, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
