1. Heard.

2. This instant CRMP is directed against the order passed by learned Magistrate, dismissing the complaint under Sections 409,

420, 467, 468, 471 & 120 B of the Indian Penal Code.

3. On being asked, learned counsel for the petitioner informs that revision/appeal was not preferred before the Court of Sessions.

Learned counsel would submit that he may be permitted to withdraw the instant CRMP with liberty to file revision/appeal along with application for condonation of delay.

4. Accordingly, the instant petition is dismissed as withdrawn with the aforesaid liberty. Needless to say that if revision/appeal along with application for condonation of delay is filed, the Court of Sessions will do well to consider and decide the same in accordance with law expeditiously.
