At the outset, it is submitted on behalf of the petitioner that Civil Appeal No.51A/12 (Victor Kerketta & Ors. vs. Shatik Kumar) is pending before First Appellant Court since 2004 and the First Appellate court may be directed to dispose of the matter finally as expeditiously as possible.

On due consideration, looking to the submission made in this behalf by the petitioner, no notice is required for respondents 1 & 2. By invoking the jurisdiction under Article 227 of the Constitution of India, the instant matter is disposed of and the Court below is directed to dispose of said first appeal as expeditiously as possible preferably within four months from the next date of hearing. The petitioner may also file a copy of the order before the First Appellate Court for compliance. Registrar (Judicial) is also directed to send a copy of the order to the First Appellate court through usual and fax mode for compliance immediately.
