This transfer petition has been filed by the wife for transfer of Civil Suit HMA 3-A/2015 pending in the Court of Sessions Judge, Pratappur, District Surajpur, to the Civil Court of Raipur.

The wife/Applicant not only appeared before the Court where the proceedings are pending but she first filed an application for rejection of the petition under Order VII Rule 11 of the Code of Civil Procedure, 1908, which was dismissed. She also filed an application for grant of interim maintenance which has been allowed. She has been granted interim maintenance and in addition to that, she has also been granted Rs. 2,500/- for attending each hearing. Thereafter, this application for transfer has been filed after the case was fixed for evidence of the husband. Therefore, it is obvious that it is only a ruse to delay the matter.
