Learned Counsel for the Appellant submits that by inadvertence it could not be brought to attention of the Learned Single Judge despite the necessary pleadings being there, that the issues involved were slightly different from other batch matters with which it was listed. Consequently, the order which has been passed is appropriately not applicable to the facts of the present case. Leave is sought to withdraw the appeal to file an application for review before the Learned Single Judge.
