Hon'ble Shri Justice P. Sam Koshy Order On Board 04/07/2017 The limited prayer of the petitioner in this case is for a direction to the respondents for grant of appointment on compassionate ground in his favour and also to quash the order dated 16/09/2004.

The grievance of the petitioner is that his father died in harness while working in Public Works Department on 20/07/2001. The petitioner had immediately applied for compassionate appointment and there is an order in his favour on 14/09/2004 whereby his name appeared for being considered for compassionate appointment. Later on, on 16/09/2004, the said order granting him compassionate appointment was withdrawn without any reason. 3.

This Court is reluctant to entertain the present petition on the ground of delay and laches. Withdrawal of candidature for compassionate appointment took place in the month of September, 2004 i.e. almost 13 years ago and for these 13

years, the petitioner did not approach this Court nor has challenged the order before any other legal forum.

In view of above, this Court find it difficult to entertain this petition at this belated stage. Accordingly, this petition is dismissed only on the ground of delay. Sd/- (P. Sam Koshy) Judge Deepti
