1. Learned counsel appearing for the respective parties fairly make a submission that the issue involved in the case stands squarely covered by the order dated 8.5.2017 passed by this Court in the cases of Bhagwat Prasad Yadav (WPS No.1654 of 2017) and Sunil Kumar Yadav (WPS No.1662 of 2017).

2. In view of the categorical admission made by learned counsel for the parties including the counsel appearing for the respondent of the factual situation being identical and similar, the present writ petition is also disposed off in similar terms as has been observed and ordered by this Court in WPS No.1654 of 2017 and

-2WPS No.1662 of 2017.

3. As a consequence, it is directed that the competent authority in the matter shall take up the case of the petitioner for review of whether it is at all imperative at this stage to continue the petitioner under suspension when the enquiry report has ended in his favour and criminal case has also not landed in the criminal Court much less framing of charge of commission of any offence. The authority shall consider the case of the petitioner also in the light of the directive given by this Court in WPS No. 1654 of 2017 and WPS No.1662 of 2017 decided on 8.5.2017 in the cases of Bhagwat Prasad Yadav and Sunil Kumar Yadav respectively, within a period of 30 days from the date of receipt of copy of this order.
