Learned counsel for the petitioner would submit that against the order dated 20.02.2020, passed by the Chief Judicial Magistrate, Baloda-

Bazar there is remedy of filing of revision petition under Section 397 read with Section 401 of Cr.P.C. before the concerned District Sessions Judge, therefore, he seeks permission of this Court to withdraw the instant CRMP with a liberty to file duly constituted revision petition.

2. Considering the submission made by the counsel for the petitioner, and the fact that the petitioner has filed the present petition on 20.03.2020 and till now the matter is pending before the Court, therefore, the period from the date of filing of the instant petition till the date of disposal of the petition will not calculate for limitation period for filing of revision petition.
