This transfer petition has been filed by the wife for transfer of case bearing Civil Suit No. 1-A of 2016 (Manoj Soni v. Smt. Raj Kumari Soni) under Section 9 of the Hindu Marriage Act, pending in the Court of Principal Judge, Family Court, Rajnandgaon to the Family Court, Durg. 2.

The Petitioner-wife has filed a petition under Section 125 Cr.P.C. which is pending in the Family Court at Durg. The Respondent-husband has to attend this proceedings at Durg, therefore, in the interest of justice, Civil Suit No. 1-A of 2016 (Manoj Soni v. Smt. Raj Kumari Soni) pending in the Court of Principal Judge, Family Court, Rajnandgaon be transferred to the Family Court, Durg.

It is however ordered that the Family Court will ensure that the same date is given in both the cases so that the husband would not suffer unnecessary burden.

The transfer petition stands disposed of.
