Mr. Sameer Behar, Panel Lawyer, for the State. This is an application filed u/s 439 Cr.P.C., for grant of bail to the applicant in connection with Crime No.171/2015 registered at P.S. Fingeshwar, Gariyaband, Chhattisgarh, for the offence punishable u/ss 354-D of IPC and Section 12 of the POCSO Act.

Learned counsel for the applicant prays for withdrawal of the bail application with liberty to file a fresh bail petition before the concerned trial court after filing of the charge sheet.

As prayed, this bail application is dismissed with the above liberty.

The petitioner, if so advised, may file a fresh bail application before the concerned trial Court after filing of the charge sheet. If such an application is filed, the concerned trial Court shall consider and decide the same on merits.
