This transfer petition has been filed by the wife for transfer of divorce case bearing C.S. No. F56A of 2016 (Madhusudan Sahu v. Smt. Shikharanai Sahu) pending before the Family Court, Raigarh to Family Court, Durg. 2.

The undisputed facts are that the parties were married to each other and out of their wedlock, one son was born, who is residing with the mother. He is aged about 5 years. Obviously, it would be inconvenient for the wife to travel alongwith her minor son to attend the Court. Both husband and wife are earning but overall convenience of wife will be more important. 3.

Keeping in view of the above facts, it would be better in the interest of justice that the divorce case bearing C.S. No. F56A of 2016 (Madhusudan

Sahu v. Smt. Shikharanai Sahu) pending before the Family Court, Raigarh be transferred to Family Court, Durg.

The transfer petition stands disposed of.
