1. This is an application filed under section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant in connection with Crime No. 282 of 2015 registered at Police station Balco Nagar, District Korba (C.G) for the offences punishable under section 354, 323 IPC.

2. As per the prosecution case, on 08.10.2015 at about 1.20 p.m., while the victim was evaluating the answer papers of students in the Institute of Technology, Civil Engineering at Korba at that time the applicant who was also working as Lecturer on contract basis in the same college entered in to the room and thereafter outraged her modesty. The said incident was reported by the father of victim on 09.10.2015.

Learned counsel for the applicant submits that both the applicant and prosecutrix are teachers in the same college and they studied together and completed their engineering courses and thereafter both were doing job in the same college and over some personal dispute, the report was made. He further submits that the applicant is in jail since 14.10.2015 and considering the period of detention, he

may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of bail.

5. Having regard to the facts situation of the case and taking into gravity of offence and the fact that the charge sheet has been filed, and the applicant is in jail since 14.10.2015, I am inclined to release him on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He shall also appear before the trial Court as and when directed by the said Court.
