Learned counsel appearing for the State would submit that petitioner is a member of Indian Administrative Service and, therefore, remedy lies to challenge the impugned order before the Central Administrative Tribunal under the provisions of Administrative Tribunals Act, 1985.

At this stage, learned Senior counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to file the same before appropriate authority or Tribunal having jurisdiction.

Liberty is granted, as prayed for.

Accordingly, the writ petition is dismissed as withdrawn with the liberty as aforesaid.
