1. The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 18.04.2020 in connection with Crime No. 168/2020 registered in Police Station- Dongargarh, District Rajnandgaon (CG) for the offence punishable under Section 34 (2) of the Excise Act.

2. At the very outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3. Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
