Versus

State Of Chhattisgarh Through : The Station House Officer, Police Station Sarangarh, Civil And Revenue District Raigarh (Chhattisgarh) ---- Respondent For applicant - Shri U.R. Koshaley, Advocate. For Respondent/State - Shri U.K.S. Chandel, PL. Hon'ble Shri Justice Goutam Bhaduri Order 17/12/2015 1.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 59/2015 registered in Police Station Sarangarh, Civil and Revenue District Raigarh (C.G.). for offence punishable under section 457, 380, 34 of the Indian Penal Code. 2.

As per the prosecution case on 10/02/2015 Prakash Agrawal lodged a report that applicant has committed theft of provision items of value of Rs.2500/- from the provision store.

3.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and no seizure was made from person of the applicant, therefore he submits that applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail and submits that Crime No. 108/2015 registered under Section 457, 380 of IPC, Crime No.77/2015 registered under Section 457, 380 of IPC, Crime No.10/2015 registered under section 394 of IPC and Crime No. 181/2015 registered under Section 457, 380 of IPC all the crimes were committed

by the applicant in year 2015 itself and while the cases were pending again same nature of crime is committed, therefore he may not be enlarged on bail.

5.

Taking into account to the credit of the applicant 4 cases are registered one is of loot and other is of theft in the year 2015 itself, taking into account short proximity of time of repetition of offence, this court is not inclined to release the applicant on bail.

6.

Accordingly, the bail application is dismissed. Certified copy as per rules.
