Hon'ble Shri Justice P. Sam Koshy Order On Board 22/04/2019

1. Grievance of the petitioner is that after having worked with respondent No.3 on contractual basis for around 8-9 years, his services have been discontinued w.e.f. 28.01.2019. The limited prayer which the petitioner has made is that since the petitioner substantively was a contractual employee and, his contractual appointment has come to an end and that there is no unsatisfactory report against the petitioner, let the

respondents take a decision whether there is need for contractual Training OfÏcer on contractual basis or not ? The petitioner further prays that let the respondents take a decision on the representation so made by the petitioner demanding for the renewal of the contractual appointment.

2. Given the limited relief that the petitioner has sought, this Court is of the opinion that the ends of justice would meet if the petitioner makes a suitable representation to the respondent Nos. 1 and 2 within a period of two weeks from today, and on receipt of said representation, the respondent Nos. 1 and 2 shall consider the representation of the petitioner and pass appropriate order. It is expected that the respondents, in case, are in need of contractual Training OfÏcer, they shall consider the case of the petitioner unless the services of the petitioner was unsatisfactory or was discontinued because of some specific misconduct or nonperformance or the petitioner is being replaced by the regular Training OfÏcer.

3. The petition is accordingly disposed of to the extent indicated herein above.
