1. The applicants have preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as they are arrested in connection with crime No.22/2021 registered in Police Station Singhoda, District - Mahasamund C.G. for the offence punishable under Section 379/34 of the I.P.C.

2. Applicants have committed theft of Hero Honda Splendor

MCRC No. 3757 of 2021 motor cycle belonging to complainant Kamal Narayan Patel.

3. Learned State counsel would oppose the prayer for grant of bail. He would submit that both the applicants have previous antecedents. The previous antecedents against the applicants are of not committing similar nature of crime. They are registered for offences under Sections 294, 323, 506, 341, 394/34 of the I.P.C.

4. Considering the fact that applicants are in jail since 03.4.2021; offences are triable by JMFC and also for the fact that charge-sheet has already been filed, I am inclined to release the applicants on bail.

5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
