The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 303/2015 registered in Police Station Thana-Gaurella, District Bilaspur (C.G.) for offence punishable under section 354, 34 of IPC & 3(1-11) of SC & ST (Prevention of Atrocity) Act.

As per the prosecution case on 24/09/2015 at about 6'O clock at village Bandatola applicant along with other co-accused came to the prosecutrix and thereafter caught hold of her and thereafter tried to outrage her modesty and after raising alarm by the prosecutrix they fled away from the scene.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case since there was previous animosity between the two families and applicant is in jail since 6/10/2015, therefore applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

I have gone through the charge sheet. Considering the statement of the prosecutrix under Section 161 of Cr.P.C. and also considering the detention of applicant that he is in jail since 6/10/2015 and charge sheet having been filed, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
