At the outset, Shri Patel submits that in the light of order passed by this Court in Writ Appeal No.305/2012 on 25/07/2012, he wants to withdraw this appeal with liberty to file detailed representation before the concerned respondents.

State counsel has no objection to this proposition. He however, submits that under the law, the appellant is not entitled to seek compassionate appointment.

Be that as it may, as the appellant wants to withdraw this appeal he is permitted to do the same with liberty as prayed for by him.
