1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No. 145 of 2015 registered at Police Station Pandari, Distt. Raipur (C.G) for the offences punishable under sections 420, 467, 468, 471, 120-B/34 IPC.
2. As per the prosecution case, the applicant along-with other coaccused Prashant Sharma and Sunita Sharma obtained different amounts from different persons to get them employed in Government department and thereafter has received huge amounts from them, therefore, the offence is committed.
3. Learned counsel for the applicant submits that the applicant was in job of placement services which assured different persons to provide them jobs. He further submits that the said placement agency belonged to one Prashant Sharma and the applicant was working as peon in the said organization and the offence has been committed by co-accused Prashant Sharma who is now
absconding. He further submits that the applicant is in jail since 13.06.2015 and looking to the period of detention, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the prayer for grant of bail.
5. Perused the statement of Chandrahas Lodhi wherein it is stated that the applicant was in the helm of affairs and the status of the applicant was not only that of a peon.
6. Taking into the statement of witness Chandrahas and considering the case diary which contains the list of various persons from whom huge amounts were collected to provide them job and the way the offence committed and considering the social impact of the offence, I am not inclined to release the applicant on regular bail. Accordingly, the bail application is dismissed.
