Learned counsel for the petitioner submits that the Respondent Authority has rejected the petitioner's representation without taking into consideration the order passed by this Court on 29.01.2013 in WP No. 4691/2004. 2.

Even if there is merit in the submission that the order passed by Respondent Authority is illegal, that by itself, without anything more, can not be made a basis to initiate the contempt proceeding. The petitioner would be at liberty to challenge the correctness of the Order by filling properly constituted writ petition to decide the petitioner's claim as per order dated 29.01.2013 in WP No. 4691/2004.
