The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 115/2014 (as per challan) wrongly mention bail rejection order lower court 115/15 registered in Police Station PS Kusmi Dist. Balrampur Ramanujganj for offence punishable under section 417, 420, 467, 468, 471, 120-B and 409 of Indian Penal Code as per challan.

As per the prosecution case the applicant in connivance with other co-accused has obtained loan in the name of Chandra Nagvanshi by taking different documents and loan of Rs. 1 lakh was obtained. Subsequently, loanee came to know when recovery notice from the bank was received.

Learned counsel for the applicant submits that the applicant has been falsely implicated and charge sheet has been filed and the complaint was made on the statement of Somnath Bhagat, applicant has taken money to provide to the Branch Manager and charge sheet having been
filed, no further evidence is required, therefore, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Having regard to the facts and circumstances of this case and the nature of allegations are primarily in the nature of documentary nature, considering the fact that charge sheet has been filed, applicant is in jail since 12/08/2015, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
